Terms of service

SECTION 1 – OVERVIEW

Wagyu Club NZ (“we”, “us”, “our”) operates this website and provides premium Wagyu beef products and related services.

By accessing or purchasing from us, you agree to these Terms.

We offer products and services to:

  • individual consumers (“Retail Customers”)
  • approved business customers (“Commercial Customers”)
  • optional membership participants (“Club Members”)

Different terms may apply depending on your customer type.


SECTION 2 – CUSTOMER TYPES

We may classify customers into:

Retail Customers

  • standard online purchases

Club Members

  • customers enrolled in Wagyu Club NZ membership programs
  • may receive special pricing, early access, or exclusive products

Commercial Customers

  • restaurants, resellers, or bulk buyers
  • subject to separate pricing, credit terms, and supply agreements

We reserve the right to:

  • approve, reject, or reclassify any customer type
  • apply different pricing, product availability, and conditions

SECTION 3 – PRODUCTS

Our products are premium Wagyu beef and are perishable.

We make every effort to accurately describe products, but:

  • marbling, color, and appearance may vary naturally
  • product images are indicative only

We do not guarantee that products will meet subjective expectations (e.g. taste preference).


SECTION 4 – ORDERS

Orders are offers to purchase and are not confirmed until accepted by us.

We may:

  • cancel or refuse orders
  • limit quantities
  • restrict orders for resale

Orders cannot be cancelled once processed.


SECTION 5 – PRICING

Prices may change at any time.

Retail, Club, and Commercial pricing may differ.

All prices exclude shipping unless stated.


SECTION 6 – SHIPPING & DELIVERY 

All delivery times are estimates only.

Due to the perishable nature of our products:

  • Customers must ensure delivery can be received promptly
  • Risk passes to the customer upon delivery or drop-off

We are not responsible for spoilage caused by:

  • unattended delivery
  • incorrect address
  • failed delivery attempts
  • carrier delays outside our control

Immediate refrigeration is required.


SECTION 7 – FOOD PRODUCTS

All products are perishable goods.

We do not accept returns or refunds for:

  • change of mind
  • incorrect selection
  • personal preference

Customers must inspect goods upon delivery.

Any issues must be reported within 24 hours, including:

  • order number
  • photos

Claims outside this timeframe may be declined.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.

Customers are responsible for proper storage after delivery.

We reserve the right to determine, acting reasonably, whether a claim qualifies for a remedy.


SECTION 8 – CLUB MEMBERSHIP

Wagyu Club NZ may offer optional membership programs.

Membership benefits may include:

  • preferential pricing
  • exclusive product access
  • priority allocation

We may:

  • modify or cancel membership programs
  • change benefits at any time

Membership does not guarantee product availability.


SECTION 9 – COMMERCIAL CUSTOMERS

Commercial customers may be subject to:

  • separate agreements
  • negotiated pricing
  • minimum order quantities
  • custom payment terms

Where a separate agreement exists, it overrides these Terms.


SECTION 10 – LIABILITY

To the extent permitted by law:

We are not liable for:

  • indirect or consequential losses
  • loss of profit or business

SECTION 11 – ERRORS

We may correct pricing or product errors and cancel affected orders.


SECTION 12 – GOVERNING LAW

These Terms are governed by New Zealand law.
